Submittal Requirements For Permit Applications For Construction of Facilities On Rights of Way

The following are the minimum submittal requirements for any facilities to be constructed on Rights of Way within the Village of Riverwoods. Such requirements are set forth in Village Ordinance 26-01-01 Amending Provisions of the Village Code Regulating Construction of Facilities on Rights of Way. By submitting an Application for Building Permit for Construction of Facilities on Rights of Ways the applicant acknowledges that they have read and understand the aforementioned Ordinance. Any questions related thereto should be referred to the Director of Community Services.

☐ Completed Application for Building Permit

No person shall construct or modify any facility on, over, above, along, upon, under, across, or within any right of way which: a) changes the location of the facility, b) adds a new facility, c) disrupts the right of way, or d) materially increases the amount of area or space occupied by the facility on, over, above, along, under, across or within the right of way, without first filing an application with the Director and obtaining a permit from the Village therefor or receiving written confirmation from the Director that an existing permit authorizes such work, except as otherwise provided in Village Code Title 7 Chapter 4. No permit shall be required for installation and maintenance of service connections to customers' premises where there will be no disruption of the right of way. Small wireless facilities shall also be subject to the permit requirements of the Village’s small cell wireless deployment ordinance. 

All applications for permits pursuant to this chapter shall be filed on a form provided by the Village and shall be filed in such number of duplicate copies as the Village may designate. The applicant may designate those portions of its application materials that it reasonably believes contain proprietary or confidential information as "proprietary" or "confidential" by clearly marking each page of such materials accordingly. No work requested under the provisions of this chapter shall commence until such time as a permit for the specific work is issued by the Village.

The application shall be made by the utility or its duly authorized representative and shall contain, at a minimum, the following:

  1. The utility's name, address, telephone and telecopy numbers;
  2. The applicant's name and address, if different than the utility, its telephone and telecopy numbers, email address, and its interest in the work;
  3. The names, addresses and telephone and telecopy numbers and email addresses of all professional consultants, if any, advising the applicant with respect to the application;
  4. The names, addresses and telephone and telecopy numbers and email addresses of all contractors and subcontractors that will perform the work;
  5. The name and 24-hour emergency telephone number of the contractor’s representative;
  6. A general description of the proposed work and the purposes and intent of the facility and the uses to which the facility will be put. The scope and detail of such description shall be appropriate to the nature and character of the work to be performed, with special emphasis on those matters likely to be affected or impacted by the work proposed.

☐ A written Traffic Control Plan

The Traffic Control Plan shall demonstrate the protective measures and devices that will be employed consistently with the "Illinois Manual On Uniform Traffic Control Devices", IDOT Standard Specifications, IDOT Highway Standards, and Village Code Section 7-4-11, to prevent injury or damage to persons or property and to minimize disruption to efficient pedestrian and vehicular traffic.

☐ An Emergency Contingency Plan

The Emergency Contingency Plan shall specify the nature of potential emergencies, including, without limitation, construction and hazardous materials emergencies, frac-out, and the intended response by the applicant. The intended response shall include notification to the Village and shall promote protection of the safety and convenience of the public. Compliance with ICC and IEPA regulations for emergency contingency plans constitutes compliance with this chapter unless the Village finds that additional information or assurances are needed.

☐ Drawings, plans and specifications depicting the work proposed

Documents shall include sufficient information regarding the area within the Village to be provided service connections as part of the installation, the types and quantities to be installed and the certification of an engineer (licensed in the State of Illinois) that such drawings, plans, and specifications comply with applicable codes, rules, and regulations. When requested by the Director, such plans shall include a plat or plats of survey showing property lines, and rights of way, existing sidewalks, curbs, gutters, underground utilities, easements, and similar features.

Drawings shall clearly indicate the location of all privately-owned properties on which work is proposed.

Drawings shall provide sufficient information and details to indicate:

  1. The identification and dimensional location of all proposed facilities with respect to edge of rights of ways, edge of pavements and the location of all existing facilities on, over, above, along, upon, under, across or within the rights of way;
  2. Location of all delineated woodlands within 40 feet of any proposed land disturbance caused by excavations, grading, vehicular movement or other construction-related activities;
  3. A Woodland/Tree Protection & Landscaping Plan including, but not limited to, details and locations of tree preservation measures as required for site development under Village Code Title 9 Chapter 6;
  4. Location of all designated wetlands and wetland buffers within 40 feet of any proposed land disturbance from excavations, grading, vehicular movement or other construction-related activities;
  5. The location of all proposed excavations or grading required to facilitate installation of the facilities;
  6. Details and location of all proposed erosion and sediment control measures;
  7. Burial depth or aerial height of proposed facilities;
  8. Construction sequencing and timeline plan;
  9. Site Restoration Plan including locations of and details for restoration measures for all pavement, landscaped, wetland and woodland areas disturbed during construction along with a sequence and time line for the restoration work; and
  10. Such additional information as may be reasonably required by the Village.

☐ Evidence of permission from appropriate private property owners to be upon that private property when such permission is required.

☐ Evidence of insurance as required by Village Code Section 7-4-7 and Village Code Title 8 Chapter 11 for the utility, contractor(s) and subcontractor(s).

☐ Evidence of posting of the security fund as required by Village Code Section 7-4-8.

☐ Any request for a variance from one or more provisions of Village Code Title 7 Chapter 4.

☐ A written agreement to reimburse the Village for the fees and expenses of the Village Engineer, Village Ecologist and other consultants retained by the Village to assist in the review of the construction drawings and ongoing construction activity in accordance with Village Code Section 1-11-6.

☐ Reasonable evidence that the permittee for such facilities has sufficient financial and operational resources to properly maintain and operate said facilities in the right of way in accordance with Village Code Title 7 Chapter 4.

☐ Such additional information as may be reasonably required by the Village.

☐ Supplemental Application Requirements For Specific Types of Utilities:

In addition to the requirements of subsection 7-4-4C, the permit application shall include the following items, as applicable to the specific utility that is the subject of the permit application:

  1. In the case of the installation of a new electric power, communications, telecommunications, cable television service, video services, fiber optic cable or natural gas distribution system, evidence that any "Certificate of Public Convenience and Necessity" or other regulatory authorization that the applicant is required by law to obtain, or that the applicant has elected to obtain, has been issued by the ICC or other jurisdictional authority;
  2. In the case of natural gas systems, state the proposed pipe size, design, construction class, and operating pressures;
  3. In the case of water lines, indicate that all requirements of the Illinois Environmental Protection Agency, Division of Public Water Supplies, have been satisfied;
  4. In the case of sewer line installations, indicate that the land and water pollution requirements of the Illinois Environmental Protection Agency, Division of Water Pollution Control, and other local or state entities with jurisdiction, have been satisfied; or
  5. In the case of small wireless facilities, applications shall address all items required by the Village’s small cell wireless deployment ordinance.
  6. In the case of installations by telecommunications providers such as fiber optic cable, the Village and permittee may enter into a specific license or permit agreement, in which case applications shall address all items required by the license or permit agreement.

☐ Application Fees:

To the extent permitted by law, and unless otherwise provided by franchise, license, or similar agreement, all applications for permits pursuant to Village Code Title 7 Chapter 4 shall be accompanied by such permit fees as from time to time may be set forth in the annual fee schedule. No application fee is required to be paid by any telecommunications retailer that is paying to the Village the Simplified Municipal Telecommunications Tax or the optional State Telecommunications Infrastructure Maintenance fee pursuant to the Telecommunications Municipal Infrastructure Maintenance Fee Act, or by any electricity utility that is paying the Municipal Electricity Infrastructure Maintenance Fee pursuant to the Electricity Infrastructure Maintenance Fee Act, 35 Illinois Compiled Statutes 645/5-1. Application fees for small wireless facilities shall also be subject to the requirements of the Village Code pertaining to such facilities.

Applicant's Duty To Update Information: Throughout the entire permit application review period and the construction period authorized by the permit, any amendments to information contained in a permit application shall be submitted by the utility in writing to the Village within thirty (30) days after the change necessitating the amendment.
